Photography Contract, Terms, Conditions

These terms may be updated at any time, and the terms that apply to your booking are those published at the time of your retainer payment.

 

It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted in writing by Stevie C Photography (“the photographer”) and you (“the client”, jointly or severely).

 

PAYMENT

Your service contract commences upon receipt of a non-refundable service retainer payment. Any cancellation must be made within 14 calendar days of the payment, in writing by post or e-mail. You will not be liable for further costs aside from any costs agreed separately (e.g. flight tickets).

Currently our initial non refundable service retainer payment is £250, unless an alternative amount is agreed in writing. This secures your date, and your photographer will not accept another wedding booking for the same time period booked.

The balance of the agreed total amount is payable no later than 30 calendar days before the wedding day.

Any additional amounts for extra coverage to be paid within 30 calendar days after the wedding.

 

PAYMENT METHODS

1. Cheque: For security, please contact us for cheque payee details and postal address.

2. Credit / Debit cards: Advance payments can also be made by card. Please see payments page. We reserve the right to pass on the card processing fee from the payment portal.

3. Cash payments accepted in some circumstances, and a receipt will be issued.

4. E-banking: For security, contact us for bank transfer details. Your ceremony date (YYMMDD) or surname is the reference number.

 

SERVICE

'Full day coverage' is defined as attendance by your photographer for a maximum of eight hours, at the agreed times. Time starts from the arrival on site or at the agreed start time, whichever is the later.

We are not responsible for any delays or variations to your wedding timetable, and if the photographer is required to stay longer then a charge of £125 per hour or part thereof is payable prior to despatch of the photos. If you ask the photographer to start earlier or finish later than the scheduled times you are agreeing to this charge. Your photographer will check with you before extra time commences, and not go beyond two additional hours without first checking with you or a nominee.

In our experience, many weddings run later than expected, so we would recommend booking additional contingency time.

Shorter weddings of 4-6 hours by arrangement, are defined as 'Part Day'.

Except for 'Part Day', and subject to your package booked, photography usually starts about one to two hours before the ceremony depending on the location and if bridal / groom preparation is being photographed. We also suggest a minimum of 30-40 minutes sometime after the ceremony to get all the other key shots and any group shots. However, it is your day, and we will not impose on your time too much! We’ll discuss with you how much time you’d like to devote to the photography, to ensure you spend as much time with your guests. If we are allocated limited time for group, formal, and portrait photos, then there will be less of those images. Images represented in sample albums and our web site are indicative of an adequate allowance of time to achieve those photos.

 

PRODUCTS

Your images are supplied on a CD(s) or flash-drive memory stick. If low resolution images are included they will be 60-300kb each. High resolution images are defined as between 1mb -3mb each. Typically a maximum of 3.6gb total per shoot. RAW archival files and higher resolution files are available at a supplement, and cost or provision of a hard drive for storage.

The number of images supplied will vary for every wedding, and will depend on factors including the length of booking, weather, time you allocate to photography, willingness of subjects, wedding style, venue restrictions, and lighting.

Unless otherwise agreed separately, packages do not include any albums, print products, CD’s or DVD’s. Payment for any albums, additional album pages/photographs, prints & frames can be made in advance, or after the wedding at the prevailing prices at time of ordering.

However, print prices have increased up to 25% in some years, so we would recommend ordering your product to secure the current prices. This can be done within 30 days of your booking, for any album / wall art / gift, or print credit.

Unless otherwise agreed, images supplied are 'straight from camera'.  Images selected for your print product can be creatively styled/retouched.

 

IMAGE STORAGE

We will retain your digital files for up to 12 months after the wedding date, and all print products should be ordered within this time. If you anticipate needing prints / albums after this period, we recommend you purchase a disc of hi-resolution original images (unless included in your package).

 

PRE WEDDING SHOOT

We are delighted to include an optional pre wedding photo shoot with all of our full-day packages. This should be arranged within three months of your wedding booking, and taken at least 3 months before the actual wedding. Please allow 1-2 hours for the shoot. The sessions are available by appointment, in central London, and subject to availability (peak season weekends get booked quickly). Appointments after three months of your booking may be subject to our minimum session fee of £99.

Images will be available to view around 1 month later.

Unless otherwise agreed in writing, these photography shoots do not include any prints/images/downloads. A proof disc will be supplied or an on-line gallery. Individual images or a CD of several/all images can be purchased if required.

The photography session are subject to availability of mutually agreeable date/time, and will take place in central London at a venue of our choice, or an alternative location subject to agreement on any additonal costs.

 

WEDDING PHOTOS - VIEWING OPTIONS

1. Studio, London. A mutually convenient appointment for viewing of photographs will be made upon return from honeymoon, not less than 4 weeks after the wedding. The images will be viewed on a large screen, and you will be able to view a wide selection of wedding albums. We may also be able to arrange viewing at your home for a small charge.

2. Preview Disc. Your previews will be dispatched by post to your home address on a pre-arranged date, not less than 4 weeks after the wedding. If you have already opted to have an album, these will usually be sent to you as a priority.

If you require the disc faster (within 7 days), then please ask for a Rush Service @ £150.

 

ALBUMS

Albums and print products are optional.

Prices quoted for print products are based on those prevailing at the time of enquiry, and are subject to change unless agreed in writing or paid in full in advance.

We request that you make your selection of images for your prints/album/book within 90 days of receipt of your images.

Orders received after this period may considerably increase the turnaround time of your finished product, and could incur any supplier's price increases or VAT changes.

Your album will be a unique bespoke design, and a £250 non-refundable design retainer is payable prior to the design being started, unless an alternative amount has been agreed in writing. The full balance of the final agreed cost is payable upon your acceptance of the design. These fees are non-refundable.

Unless agreed in writing beforehand, if the balance payment for the album / print product has not been made within 14 days of the design being agreed, then we reserve the right to use the applicable price list prevailing at that date. If you decide not to proceed with the purchase, then the design retainer is non-refundable. The album design is copyright Stevie C Photography, and therefore the design files are not transferable.

The normal lead times on albums and books is approximately 4 weeks for initial design to be submitted to you, then a further 6-8 weeks from approved submitted design. Any design amendments requested can add 2 weeks minimum.

Note that these timescales fall outside of the 30 day delivery period from the European Rights Directive / Consumer Contracts (information, cancellation and additional charges) Regulations 2013. Please do not commission us to supply an album / print product if do not agree to these timescales.

As your album is a bespoke product designed for you, cancellation or return is not possible after the order has been placed with the supplier.

 

We can request a rush-job, and a fee is chargeable in these instances:

Faster submission of album design (7 working days) £200.

Faster album delivery (10 working days) from £100 depending on album size.

Note that when ordering digital albums (edge to edge printing), there can sometimes be a crease mark visible in the centre of some the double-page spread, depending on the density of the image colour. This is beyond our control, and is normal for this type of product.

We accept no liability for delays caused by 3rd party suppliers that are beyond our control.

 

EXCLUSIVITY

Stevie C Photography shall be the sole professional photographer at the venues specified. We want to help you maximise your time and get the photos quickly and without distraction. Although we appreciate that guests will want to take pictures, we ask them to allow the photographer to carry out his work without obstruction. However, we will help people to get some great shots if necessary.

 

If applicable, please provide the contact details for any videographer booked for your day.

 

COPYRIGHT

The 1988 Copyright, Designs, and Patents Act assigns copyright to Stevie C Photography. You may not copy the photographs taken under this contract, or allow copies to be made photographically, electronically, or by any other means.

If a disk of images is purchased or included in your package, we provide you with a license to reproduce these for your own personal non-commercial use. If used in any printed medium, credit must be given as “photo by Stevie C Photography”.  The images must not be altered in any way.

Please contact us if you would like to license the images for commercial use.

 

MODEL RELEASE

We reserve the right to use any images taken by us for marketing, advertising, blog, social networking and promotional purposes. The Client hereby grants to Stevie C Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases Stevie C Photography and its legal representatives and assigns from all claims and liability relating to said photographs.

However, discretion is important to us, and we will consider any written request for anonymity, and avoid using any photographs that include children. Further details are available on request.

 

CREATIVE LICENCE

Stevie C Photography shall be granted creative and artistic licence in relation to the choice of locations, subjects, and poses used. The photographer’s judgement on photographic style, colour or black & white, and the number of photographs taken shall be deemed correct.

We may have discussed in advance what key shots you would like. Due to changes of the weather, light conditions, and the availability / willingness of subjects, the photographer will do his best to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

For an agreed fee, your photographs can be added to an on-line gallery on our web site, which can be password protected on request.

We aim to deliver a quality product and service consistent with work examples shown to you. Other than normal colour correction and exposure, only images chosen for albums and printed product will receive additional retouching and creative styling, at our discretion. If additional retouching is requested by you (e.g. skin corrections, body-shaping, removing elements of the image, etc) then this may be chargeable at £10 per image. Please check with us if unsure.

You may want to include photos taken by your guest in the album. A charge of £10 per photo is made when we are asked to retouch images from your guests.

 

PUBLIC LIABILITY

You agree to release Stevie C Photography and its employees (paid or unpaid), directors, affiliates, agents, representatives, successors (collectively the "Releasees") from all liability, claims, demands, damages, costs, expenses, actions and causes of action (collectively the "Claims") in respect of death, injury, loss or damage to you or property howsoever caused, arising or to arise by reason of or during your participation in the photography session, whether prior to, during or subsequent to your attendance and notwithstanding that any Claim may have been contributed to or occasioned by the negligence of any of the Releasees.

 

FORCE MAJEURE

In the unlikely event of total photographic failure, acts of God, injury or sickness beyond the photographer’s control, his liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

 

BOOKING

A non-refundable retainer of £250 is required at the time of booking (or other amount as agreed in writing).

Until a retainer payment has been made your specific date is subject to cancellation, prices are subject to change and special offers may change. To secure your date and tariff, please ensure that your retainer payment is made as soon as possible.

Upon receipt of your retainer payment we offer to provide the agreed services on the specific date.

Unless otherwise agreed in writing, your specific date is reserved and service commences immediately upon receipt of your retainer payment. Under the European Rights Directive / Consumer Contracts (information, cancellation and additional charges) Regulations 2013 you have a 14 calendar day cooling off period, and after this period you are liable for the full contract cost and the scale of cancellation charges detailed on this page.

Digital downloads of images and printed products are exempt from cancellation once supplied.

Gift vouchers are available as a product.

For payments by debit and credit cards we reserve the right to charge a handling fee equivalent to the fee levied by the card processing provider.

 

BALANCE PAYMENT

The remaining balance is to be paid no later than 30 calendar days prior to the wedding date.  If you have upgraded your package since the initial booking, then the final total balance is payable.

For bookings within 30 days, the full sum is payable.

Unless agreed in writing beforehand, if the balance payment has not been made 12 hours before the agreed attendance date and time, you will be deemed to have cancelled the contract. The photographer will be under no obligation to provide the service, and you will be liable for the cancellation charges as set out below.

Any additional amounts for extra coverage to be paid within 30 calendar days after the wedding.

 

CANCELLATION

Should the photographer need to cancel this contract for reasons beyond their control (death, injury, personal or family sickness, travel problems etc.), or acts of God, their liability shall be limited to a full refund of all monies paid.

In these instances, the photographer would at his discretion aim to propose a substitute(s) photographer for you, who would be of a similar or greater standard.

 

If you cancel the booking, compensation for loss of income for Stevie C Photography is payable, in addition to the retainer paid.

Number of days before the wedding:

Over 120 days: 25% of balance payable

91-120 days: 50% of balance payable.

61-90 days: 75% of balance payable.

60 days or less: full balance payable.

In addition, any non-cancellable travel costs (e.g. Flights) need to be recompensed in full in the event of cancellation.

 

POSTPONEMENT

Should the wedding be postponed, then, subject to the photographer's availability, all money paid may be applied to the new wedding at prevailing Stevie C rates. This is however restricted to a time period of 18 months from the original wedding date booked, otherwise any fees paid / due become non-refundable.  Any special offers may be voided, unless  otherwise agreed in writing.

In the event of Stevie C Photography obtaining another wedding booking for your cancelled/ postponed date, at the equivalent value, then a refund of money paid can be considered (less your original retainer).

In addition, costs for travel amendments/cancellation (e.g. Flights) need to be recompensed in full in the event of postponement.

 

We strongly recommend that you take out comprehensive insurance for your wedding at the earliest opportunity (typical cost is from £60 for £20,000 cover).

 

PRIVACY

Stevie C respect your privacy, and will only store your name and wedding details on our private internal database. Your address details will not be made available to external companies.

If we send you any e-mails or mobile texts before or after the wedding, you may opt out at any time by replying to the e-mail or text with the message 'unsubscribe'.

 

GOVERNING LAW AND JURISDICTION

The Contract shall be governed and construed in accordance with the laws of the United Kingdom.  The English Courts will have exclusive jurisdiction to deal with any dispute which may arise out of or in connection with the Contract.
